Terms of Service for BOFRID

1. Introduction

These terms ("Terms") govern the use of the Bofrid platform provided by devdash AB (559513-3124), hereinafter referred to as "Bofrid" or "we". By creating an account or using our services, you agree to these Terms.

2. Service Description

Bofrid is a marketplace and digital platform where landlords and tenants can create, sign, and manage rental agreements digitally.

  • You use Bofrid's standard rental agreement template.
  • Payment requirement: All rent payments must be made through Bofrid's invoicing service (via our partner Billecta).
  • Payment flow: The tenant pays Bofrid with discharging effect according to power of attorney. Bofrid then forwards the rent to the landlord.
  • Fees: For providing the service, Bofrid charges a service fee. Any service fee is displayed at checkout.

As a user of the Service, you acknowledge that:

  • Bofrid is not a party to any rental agreement;
  • Bofrid does not undertake any brokerage assignment;
  • Bofrid is not a real estate agent, rental agent, any form of broker, agent, or insurer, and Bofrid has no obligations or responsibilities incumbent upon such actors; and
  • Bofrid does not own, administer, or manage real property.

Note that all obligations and/or guarantees that the tenant undertakes in these terms are towards the landlord in connection with the rental agreement that the tenant has entered into with the landlord. The tenant does not have any customer relationship with Bofrid.

Bofrid reserves the right to adjust the Service Fee for listings published after a certain date. Any price changes shall only apply to newly published listings and shall not affect listings that have been published or saved as drafts before the price change, nor rental agreements that have already been signed through Bofrid. Once a rental agreement has been signed through Bofrid with an established Service Fee, the agreed Service Fee shall remain unchanged for the duration of the agreement.

Payment Assignment and Power of Attorney

2.1 Payment Assignment and Power of Attorney

By using the service, the landlord gives Bofrid (and our partner Billecta) an assignment and power of attorney to:

  • Administer invoicing of the rent in the landlord's name or on behalf of the landlord
  • Receive payment from the tenant with discharging effect for the tenant
  • Forward the rent payment to the landlord (minus any service fee) after payment has been received from the tenant
  • In case of non-payment, send reminders on behalf of the landlord

Consent to Personal Data Processing

By using the service, you consent to Billecta processing your personal data (name, personal identity number, contact details, bank/payment details) in order to provide the payment intermediation service. Complete information about Billecta's processing of your personal data can be found in our Privacy Policy.

Note: Bofrid does not assume the claim or credit risk. The landlord remains the formal creditor.

2.2 Disbursement and Client Funds

Bofrid (via Billecta) pays the rent to the landlord only after full payment has been received from the tenant. Bofrid does not advance money and does not guarantee the tenant's ability to pay.

Deposits received from the tenant are treated as client funds and kept separate from Bofrid's own assets until disbursement is made to the landlord.

2.3 Landlord's Obligations

The landlord undertakes to:

  • Not receive payment directly from the tenant (so-called bypass invoicing). All payment shall be made through Bofrid according to the assignment agreement.
  • Immediately inform Bofrid if the tenant disputes an invoice or has objections to the rent amount.
  • Repay incorrectly disbursed funds if the tenant later proves to be entitled to a refund (e.g., in case of a dispute about rent reduction or incorrect billing).
  • Inform Bofrid if you have tax obligations in a country other than Sweden.

2.4 Service Fee

For providing the service, Bofrid charges a service fee that the tenant pays in addition to the rent. The service fee is added as a separate item on the tenant's invoice.

The landlord receives the rent (base rent and any additional costs) without the service fee being included in the disbursement. The service fee belongs to Bofrid as compensation for the payment intermediation and related services. The service fee may be adjusted proportionally in the event of any rent increases during the term of the rental agreement.

2.5 Tenant's Obligations

The tenant undertakes to:

  • Pay all rent and deposits exclusively through Bofrid's invoicing service (Billecta). Direct payment to the landlord is prohibited.
  • Follow the payment terms as stated in the rental agreement and these terms of service.
  • Immediately inform Bofrid if the landlord requests direct payment outside the platform.

3. Prerequisites for Using the Service

The Service may only be used for housing located in Sweden.

To use the service, you must:

  • Be at least 18 years old. The service may also be used by legal entities.
  • Have a valid Swedish BankID.
  • Landlords who want to use the Service must have a Swedish personal identity number.
  • Not appear on sanctions lists or violate the Money Laundering Act (SFS 2017:630).
  • Agree that we may perform automated checks (e.g., credit report) when applying.

For Bofrid to be able to provide the Service and process payments to the landlord, the landlord must have fulfilled Bofrid's customer due diligence requirements.

You are responsible for protecting your login credentials and ensuring that information you upload is truthful.

Bofrid reserves the right not to provide its services to persons or companies that have provided false information, abuse or have abused Bofrid's services, violate or have previously violated these terms, other terms provided by Bofrid, Bofrid's current usage guidelines, or laws and regulations.

Bofrid reserves the right not to offer the Service to any person or company that is subject to international sanctions, including sanctions imposed by the European Union, Sweden, or the UN, or acting for or on behalf of such sanctioned parties. "Sanctions" means economic or financial sanctions, trade sanctions, export controls, restrictions against money laundering, terrorist financing, or other similar laws and regulations.

You can view the properties advertised without creating an account with Bofrid. If you want to publish a listing, express interest in a property, or contact a landlord who has advertised with Bofrid, you must create an account.

If you use Bofrid's service or website in violation of the terms of service, laws, regulations, or other rules, or act to the detriment of another party, Bofrid has the right to inform that other party about you and your actions.

In connection with the use of the Service, you undertake not to:

  • violate laws, regulations, court decisions, authority decisions, board decisions, or similar, including property law restrictions and tax rules,
  • use manual or automated software, search engines, algorithms, technical tools, or other methods to copy, collect, or scrape information from any of Bofrid's websites, the marketplace, or the service or other websites accessible through these platforms,
  • use the service or material related to the service for commercial or other purposes than those expressly permitted under these terms,
  • copy, store, or otherwise use information about properties or users for purposes other than renting or leasing a property through the Service,
  • attempt to damage or affect the Service, for example through viruses, malicious code, or methods that may overload or disrupt Bofrid's systems, networks, or services,
  • use the Service to spread spam or advertising,
  • use or distribute material, users' identity, personal data, or other information belonging to other users without their consent,
  • provide false, incomplete, or misleading information to Bofrid or other users,
  • act as a representative, agent, or intermediary for another landlord or tenant without this being clearly stated,
  • use the Service to publish pornography, political opinions, offensive material, or other content that violates good practice or Bofrid's guidelines,
  • encourage or assist anyone who intends to do any of the above.

4. Your Personal Data

In order for us to provide you with access to the Service, we need to collect and process certain personal data about you. Bofrid's Privacy Policy contains information about what data we collect, how we use your personal data, and what choices and rights you have.

Our partner Billecta processes personal data as described in the Privacy Policy in order to provide invoicing, payment collection, and disbursements.

By accepting these terms, you consent to the following use of your personal data:

  • In connection with an application process, we may perform automated checks to determine if you meet the landlord's requirements.
  • To ensure a reliable and secure experience on the Bofrid marketplace, we may process personal data related to your identity, including verification via BankID, or by requesting a copy of your ID document. We may also request proof that you own or rent the property you are advertising.

5. Rental Agreement

A prerequisite for using the part of Bofrid's Service that includes a solution for secure payments, deposit management, and support is that the landlord and tenant sign the digital rental agreement provided through Bofrid.

Bofrid is not a party to the rental agreement between landlord and tenant. Bofrid only provides a digital platform to facilitate contact and contract signing between the parties.

The landlord and tenant shall ensure that the rental agreement reflects what is stated in the listing and what the landlord and tenant have otherwise agreed upon. If the property is rented out furnished, the landlord is responsible for documenting which inventory items are included in the rental.

  • The parties are responsible for ensuring that the agreement is legal and correctly filled out.
  • Bofrid acts as a payment intermediary according to power of attorney but takes no responsibility for the condition of the property or disputes between the parties.
  • We recommend that you investigate whether the rental requires permission from the housing cooperative, landlord, or other relevant parties.

5.1 Requirements for Rental Agreement Content

The rental agreement signed through Bofrid shall state that:

  • all rent and other fees shall be paid monthly in advance through Bofrid's invoicing service (Billecta);
  • direct payment between landlord and tenant is prohibited during the entire rental period;
  • if the tenant is to pay a deposit, it shall be paid no later than ten (10) days before the first rental day or as soon as possible if the rental agreement is signed within ten (10) days of the first rental day;
  • the parties accept and undertake to follow Bofrid's payment terms according to section 2.

5.2 Parties' Responsibilities

The landlord and tenant are responsible for their respective obligations under the rental agreement and applicable law. This means, among other things, that whoever wants to terminate the rental agreement is responsible for doing so correctly.

5.3 House Rules and Obligations

The landlord shall inform the tenant of the house rules and obligations that apply to the property. If obligations such as stairwell cleaning are included, this must be clearly communicated to the tenant before the rental agreement is signed.

6. Advertising

6.1 The landlord certifies that no advance rent or deposit is collected before the property has been shown and a rental agreement has been signed. Bofrid reserves the right to remove listings and suspend users where it has been found that this certification has not been followed.

6.2 Bofrid reserves the right to publish, or otherwise use the listing, on platforms other than bofrid.se.

6.3 The landlord uses Bofrid to publish their listing, which may also be made available on platforms other than bofrid.se. The landlord may, through Bofrid's service, choose to publish their listing on platforms other than bofrid.se. In such cases, the landlord is to be considered the advertiser, while Bofrid only provides a distribution service and is not responsible for the listing's content.

6.4 Listings remain as long as the landlord is active. If the landlord does not show activity for a continuous period of three weeks, the listing may be removed.

7. Deposit

7.1 If the tenant is to pay a deposit to Bofrid, it shall be paid no later than ten (10) days before the first rental day or as soon as possible if the rental agreement is signed within ten (10) days of the first rental day. The deposit must always be paid before the tenant gains access to the property.

7.2 Deposits received from the tenant are treated as client funds and kept separate from Bofrid's own assets until disbursement is made.

7.3 The deposit may be used as compensation for the tenant's missed payment if the tenant does not pay Bofrid's invoice on time.

7.4 Upon termination of the rental agreement, the deposit shall be refunded to the tenant. Bofrid has the right to await approval from both the landlord and the tenant.

7.5 If the landlord has objections to the deposit being refunded to the tenant, this shall be notified within ten (10) days from the termination of the rental agreement. If no objections have been received by Bofrid during this time, the landlord is deemed to have approved the refund to the tenant.

7.6 Bofrid has the right to refund or disburse the deposit regardless of the landlord's or tenant's objections and shall not have any obligation to pay compensation or damages for incorrectly disbursed deposits.

7.7 For Bofrid to be able to refund the deposit to the tenant, the tenant must provide a bank account approved by Bofrid.

7.8 The landlord and tenant shall hold Bofrid harmless for any claims, demands, or similar from the other party regarding the deposit (such as handling, disbursement, or otherwise).

7.9 A landlord may not use a company they own or control to invoice themselves for cleaning services related to the rental property.

7.10 For damages caused by the tenant, compensation shall correspond to the acquisition value after age deduction.

8. Communication

All parties undertake to immediately respond to messages and calls from each other or Bofrid with correct, complete, and truthful information.

The landlord and tenant shall be reachable throughout the rental period and are responsible for updating each other and Bofrid with new contact information.

9. Right of Withdrawal & Termination of the Service

Right of Withdrawal

When you purchase services via the Internet, you generally have a 14-day right of withdrawal from the date of the agreement. Since the Service provides digital tools for creating and managing rental agreements between landlord and tenant, and the rental agreement signed through Bofrid is legally binding between the parties, you cannot unilaterally withdraw from the Service after the rental agreement has been signed. If you want to terminate the Service, you need to either terminate the rental agreement or obtain the counterparty's approval. Contact us for assistance with this.

Ending the Service

As long as the tenant and landlord have an ongoing rental agreement signed through Bofrid, the rental will be covered by the Service. When the rental agreement expires, the Service automatically ends unless the landlord and tenant have extended the rental agreement or signed a new rental agreement through Bofrid.

Termination of the Rental Agreement

If the rental agreement is terminated by either party, the party who terminated the rental agreement is responsible for immediately notifying Bofrid and the other party about this and the date on which the rental agreement ends. If the rental agreement is to end with a shorter notice period than stated in the rental agreement, both the landlord and the tenant must sign the confirmation sent from Bofrid.

Termination for Breach of Terms

If the landlord or tenant breaches the payment terms by making direct payments outside the platform (so-called bypass invoicing), or otherwise fails to follow the Terms of Service or Bofrid's instructions, Bofrid reserves the right to:

  • Immediately terminate the provision of the Service;
  • Suspend the user's account;
  • Remove the rental agreement and listings associated with the account from the platform.

Legal Disputes

If legal uncertainties or disputes arise between the tenant and landlord regarding the termination or validity of the rental agreement, Bofrid has the right to remove the rental agreement from the Service.

Bofrid reserves the right to block or suspend a user who abuses, manipulates, or uses the Service in violation of these terms.

10. Limitation of Liability

Bofrid does not guarantee continuous, uninterrupted, or secure access to the service. The operation of Bofrid's website may be disrupted by a number of factors beyond Bofrid's control, and Bofrid makes no guarantees regarding the website's function or availability.

To the extent permitted by applicable law, Bofrid cannot be held liable for damages directly or indirectly caused by the use of the service.

Bofrid has no part in the rental relationship between landlord and tenant and is not responsible for the advertised property.

Bofrid is not responsible for damage due to missed or delayed listing responses or incorrect information in the listing text.

In addition to the above, Bofrid shall not in any case be liable for:

  • That the tenant or landlord complies with laws, regulations, authority decisions, or similar, or fulfills (or can fulfill) agreements or other obligations
  • The tenant's or landlord's ability to pay or suitability
  • Any statement or claim about a particular property or other information in a listing is correct, complete, or non-misleading (including that the landlord has access to the property as stated in the listing and that the property is suitable or safe as a residence or for other use)
  • That all information provided by the landlord or tenant, for example on their user account, is complete, correct, and current

Rental agreements are entered into directly between landlord and tenant, and it is your responsibility to make the investigations, checks, and examinations needed about your counterparty, the property, and other circumstances.

If a technical disruption caused by Bofrid or its service provider, or any other factor beyond Bofrid's control, disrupts the use of the service, users must immediately notify Bofrid and act according to the instructions provided by Bofrid.

Bofrid is not responsible for information that users provide themselves.

AI Tools: Bofrid may use AI-powered tools to improve customer support and other parts of the Service. By using the Service, you accept that such AI tools may be used in interactions with you. These tools generate responses automatically and may sometimes be inaccurate or incomplete. Bofrid takes no responsibility for the accuracy, completeness, or reliability of responses generated by AI tools. Users always have the right to request that their case be handled by a human representative.

Guardianship and Estate: It is the user's responsibility to ensure that they, in case of guardianship or estate, have the legal authority to create a user profile, rent a property, or enter into a rental agreement for the party they represent. The user must follow customer support's instructions and provide necessary documents; otherwise, the user may be denied access to the website and service.

About Bo-merit: We do not guarantee the accuracy of the "Bo-merit" score as it is based on automated data and submitted documents. Bo-merit is a tool to facilitate assessment but does not guarantee a tenant's suitability or ability to pay.

11. Assignment of Your Agreement with Bofrid

By accepting these terms, you agree that the agreement entered into with Bofrid may, without your consent, be assigned to another company in connection with a business transfer that includes the Service.

12. Accessibility to the Services

Bofrid is committed to making our Services accessible and usable for as many people as possible, including people with disabilities. We have taken measures to ensure that our services, websites, and applications are:

  • Perceivable - Information is presented in ways that users can perceive and understand (e.g., via text, audio, readable fonts, clear structure, and sufficient contrast).
  • Operable - Interfaces work with different input methods such as keyboard-only navigation or voice control.
  • Understandable - Content and processes are clear, consistent, and avoid unnecessary complexity.
  • Robust - The services are compatible with assistive technology and assistive devices.

13. Changes to the Terms

Bofrid may need to make changes to these terms from time to time. Changes will be notified to existing users at least one (1) month before they take effect. If we make significant changes that require the landlord's consent, we will obtain this before the change takes effect. You have the right to withdraw from the agreement from the time you were notified of the change until the day before it takes effect. As a landlord, by consenting to such a change, you undertake to ensure that tenants under ongoing rental agreements approve the updated terms. If you do not accept the changed terms of service, you must stop using the Service according to Bofrid's instructions.

14. Intellectual Property and User-Generated Content

devdash AB owns all rights to the platform, code, and design. You may not copy, "scrape", or misuse the content.

By using the Service, you guarantee that you hold the necessary rights to all content you upload, either by having created it yourself or by having received permission from all contributors.

You guarantee that persons who can be identified in uploaded material are aware of how the material will be used and have consented to appear in the material.

You are responsible for ensuring that all uploaded content, including images, does not infringe on third-party rights, such as copyright or other intellectual property rights. If unauthorized images are used and this leads to claims or damages, you bear full responsibility.

15. Penalty for Violations

In the event that a landlord, housing seeker, tenant, or other user violates any provision of these terms, a penalty of up to SEK 20,000 shall be payable to devdash AB for each violation. devdash AB also reserves the right to claim damages.

16. Applicable Law and Dispute Resolution

16.1 Swedish law shall apply to the Services and the terms. Disputes shall be settled by a Swedish general court.

16.2 If you want to appeal a decision made by Bofrid regarding your use of the Service or content on the Service, you can submit a complaint through Bofrid's internal complaint handling system within six (6) months from the date of the decision by responding to the email you received with the decision or by contacting Bofrid. Bofrid processes all incoming complaints in order of receipt through review by qualified personnel. The internal complaint handling function is free of charge. Submitting multiple unfounded complaints may result in the account being frozen.

16.3 If the dispute cannot be resolved through the internal complaint handling function, you have the option to refer the dispute to the National Board for Consumer Disputes (ARN) or another approved body for out-of-court dispute resolution. You also have the right to refer the dispute for settlement by a Swedish general court.
