Terms of Service for BOFRID

The Service may only be used for housing located in Sweden.

To use the Service, you must:

• Be at least 18 years of age. The Service may also be used by legal entities.
• Have a valid Swedish BankID.
• Landlords wishing to use the Service must have a Swedish personal identity number.
• Not appear on any sanctions lists or violate the Anti-Money Laundering Act (SFS 2017:630).
• Agree that we may perform automated checks (e.g. Bo-merit/credit checks) in connection with applications.

You are responsible for protecting your login credentials and ensuring that the information you upload is truthful.

Bofrid reserves the right to deny its services to persons or companies that have provided false information, misuse or have misused Bofrid's services, violate or have previously violated these Terms, other terms provided by Bofrid, Bofrid's applicable usage guidelines, or laws and regulations.

Bofrid reserves the right to deny the Service to any person or company subject to international sanctions, including sanctions imposed by the European Union, Sweden, or the United Nations, or acting for or on behalf of such sanctioned parties. "Sanctions" refers to economic or financial sanctions, trade sanctions, export controls, anti-money laundering restrictions, terrorism financing restrictions, or other similar laws and regulations.

You may view housing listings without creating a Bofrid account. If you wish to publish a listing, express interest in a property, or contact a landlord, you must create an account.

If you use Bofrid's service or website in violation of these Terms, laws, regulations, or other rules, or act to the detriment of another party, Bofrid has the right to inform the other party about you and your actions.

In connection with the use of the Service, you agree not to:

• violate laws, regulations, court orders, government decisions, board decisions, or similar, including property law restrictions and tax rules,
• use manual or automated software, search engines, algorithms, technical tools, or other methods to copy, collect, or scrape information from any of Bofrid's websites, the marketplace, or the Service or other websites accessible via these platforms,
• use the Service or materials related to the Service for commercial or other purposes than those expressly permitted under these Terms,
• copy, store, or otherwise use information about housing or users for purposes other than renting or letting housing via the Service,
• attempt to damage or affect the Service, for example through viruses, malicious code, or methods that may overload or disrupt Bofrid's systems, networks, or services,
• use the Service to distribute spam or advertising,
• use or distribute material, users' identities, personal data, or other information belonging to other users without their consent,
• share contact details revealed via the Service's Reveal feature with third parties without the affected person's consent,
• provide false, incomplete, or misleading information to Bofrid or other users,
• act as a representative, agent, or intermediary for another landlord or tenant without this being clearly stated,
• use the Service to publish pornography, political opinions, offensive material, or other content that violates good practice or Bofrid's guidelines,
• encourage or assist anyone intending to do any of the above.

When a housing seeker applies for a property, a masked profile is presented to the landlord. The masked profile contains certain information about the candidate, such as name, age, job title, uploaded documents, and a personal statement, but contact details (email address and phone number) are hidden.

The landlord must use a contact reveal ("Reveal") to see the candidate's contact details. A reveal is permanent and cannot be undone.

By applying for a property, housing seekers agree that their profile, including uploaded documents and information, will be shared with the landlord in masked form, and that their contact details may be revealed if the landlord chooses to use a Reveal.

Abuse Protection: Contact details revealed via the Service may only be used to establish contact with the candidate regarding the relevant property. It is prohibited to use revealed information for marketing, distribution to third parties, or other purposes not directly related to the rental.

To provide you with access to the Service, we need to collect and process certain personal data about you. Bofrid's Privacy Policy contains information about what data we collect, how we use your personal data, and what choices and rights you have.

By accepting these Terms, you consent to the following use of your personal data:

• In connection with an application process, we may perform automated checks to determine whether you meet the landlord's requirements.
• To ensure a reliable and secure experience on the Bofrid marketplace, we may process personal data related to your identity, including verification via BankID or by requesting a copy of your ID document. We may also request proof that you own or rent the property you are advertising.
• Your contact details may be revealed to a landlord through the Reveal feature if you have applied for a property that the landlord has advertised.

7.1 The landlord warrants that they have the right to rent out the property being advertised and that the listing content is accurate and not misleading.

7.2 The landlord warrants that no advance rent or deposit is collected before the property has been shown and a lease agreement has been signed. Bofrid reserves the right to remove listings and suspend users where it has been found that this warranty has not been followed.

7.3 Bofrid reserves the right to publish, or otherwise use, the listing on platforms other than bofrid.se.

7.4 The landlord uses Bofrid to publish their listing, which may also be made available on platforms other than bofrid.se. The landlord may choose to publish their listing on additional platforms through Bofrid's service. In such cases, the landlord is considered the advertiser, while Bofrid merely provides a distribution service and is not responsible for the listing content.

7.5 Listings remain active as long as the landlord is active. If the landlord does not show activity for a consecutive period of three weeks, the listing may be removed.

All parties agree to promptly respond to messages and calls from each other or Bofrid with correct, complete, and accurate information.

Landlords and housing seekers shall be reachable throughout the time they are actively using the platform and are responsible for keeping their contact information up to date.

Bofrid reserves the right to block or suspend a user who misuses, manipulates, or uses the Service in violation of these Terms.

Bofrid does not guarantee continuous, uninterrupted, or secure access to the Service. The operation of Bofrid's website may be disrupted by a number of factors beyond Bofrid's control, and Bofrid makes no guarantees regarding the function or availability of its website.

To the extent permitted by applicable law, Bofrid cannot be held liable for damages directly or indirectly caused by the use of the Service.

Bofrid has no part in the rental relationship between landlord and tenant and is not responsible for the advertised property.

Bofrid is not responsible for damages caused by delayed or absent listing responses or incorrect information in listing texts.

Any lease agreements are entered into directly between landlord and tenant, and it is your responsibility to conduct the necessary investigations, checks, and inquiries about your counterparty, the property, and other circumstances.

If a technical disruption caused by Bofrid or its service provider, or any other factor beyond Bofrid's control, disrupts the use of the Service, users must immediately notify Bofrid and act according to the instructions provided by Bofrid.

Bofrid is not responsible for information provided by users themselves.

AI Tools: Bofrid may use AI-powered tools to improve customer support and other parts of the Service. By using the Service, you accept that such AI tools may be used in interactions with you. These tools generate responses automatically and may sometimes be inaccurate or incomplete. Bofrid assumes no responsibility for the accuracy, completeness, or reliability of responses generated by AI tools. Users always have the right to request that their matter be handled by a human representative.

Guardianship and Estates: It is the user's responsibility to ensure that, in cases of guardianship or estate administration, they have the legal authority to create a user profile, rent a property, or enter into a lease agreement for the party they represent. The user must follow customer support instructions and provide necessary documents; otherwise, the user may be denied access to the website and Service.

About Bo-merit: We do not guarantee the accuracy of the "Bo-merit" score as it is based on automated data and submitted documents. Bo-merit is a tool to facilitate assessment but does not guarantee a tenant's suitability or payment ability.

Bofrid is committed to making our Services accessible and usable for as many people as possible, including persons with disabilities. We have taken measures to ensure that our services, websites, and applications are:

• Perceivable – Information is presented in ways that users can perceive and understand (e.g. via text, audio, readable fonts, clear structure, and sufficient contrast).
• Operable – Interfaces work with different input methods such as keyboard-only navigation or voice control.
• Understandable – Content and processes are clear, consistent, and avoid unnecessary complexity.
• Robust – The services are compatible with assistive tools and assistive technology.

By using the Service, you warrant that you hold the necessary rights to all content you upload, either by having created it yourself or by having received permission from all contributors.

You warrant that persons who can be identified in uploaded material are aware of how the material will be used and have consented to appearing in the material.

You are responsible for ensuring that all uploaded content, including images, does not infringe upon third-party rights, such as copyright or other intellectual property rights. If unauthorized images are used and this leads to claims or damages, you bear full responsibility.

16.1 Swedish law shall apply to the Services and these Terms. Disputes shall be resolved by Swedish general courts.

16.2 If you wish to appeal a decision made by Bofrid regarding your use of the Service or content on the Service, you may file a complaint through Bofrid's internal complaints handling system within six (6) months of the date of the decision, by replying to the email you received with the decision or by contacting Bofrid. Bofrid processes all incoming complaints in order of receipt through review by qualified personnel. The internal complaints handling function is free of charge. Submitting multiple unfounded complaints may result in your account being frozen.

16.3 If the dispute cannot be resolved through the internal complaints handling function, you have the option to refer the dispute to the National Board for Consumer Disputes (ARN) or another approved body for out-of-court dispute resolution. You also have the right to refer the dispute for resolution by a Swedish general court.
