What does it mean?
Besittningsskydd is the legal cornerstone of tenant rights in Sweden. As a first-hand tenant, it gives you the right to remain in your home even if the landlord wants to terminate the lease. The landlord must have valid legal grounds — such as unpaid rent, serious disturbances, or planned demolition — for termination to be approved.
The protection applies automatically after the lease has been running for more than nine months (for residential leases). It can, however, be waived in certain situations, particularly in subletting arrangements. First-hand tenants have the strongest protection, while subtenants may have limited or no protection depending on the agreement.
